These Terms and Conditions ("Agreement") govern your use of the Mogem Online Radio mobile application ("App") available on the Google Play Store. The App is operated by the Mountain of God Evangelical Ministry ("MOGEM"). By installing, accessing, or using the App, you agree to be bound by this Agreement.
1.1. Grant of License: MOGEM grants you a non-exclusive, non-transferable, revocable license to install and use the App on your mobile device for personal, non-commercial purposes, subject to the terms and conditions of this Agreement.
1.2. Restrictions: You shall not copy, modify, distribute, sell, lease, sublicense, or reverse engineer the App. You shall not attempt to gain unauthorized access to any portion of the App or its related systems.
2.1. Church Broadcast: The App provides an online radio station solely for the Mountain of God Evangelical Ministry to broadcast their messages and sermons. MOGEM reserves the right to modify, suspend, or terminate the availability of any content or service provided through the App at any time.
2.2. Ads: The App may contain advertisements from third-party advertising networks, including but not limited to AdMob, Facebook Ads, AppLovin, and Wordise. By using the App, you agree to the display of such advertisements. MOGEM does not endorse or control the content of these advertisements and is not responsible for any actions or omissions of the advertisers.
3.1. Privacy Policy: Your privacy is important to us. MOGEM's Privacy Policy, available at Click to Privacy Policy, explains how we collect, use, and protect your personal information when you use the App. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
3.2. OneSignal Notifications: The App uses the OneSignal notification service to send you push notifications. By using the App, you agree to receive such notifications and acknowledge that you can control the settings for these notifications through your device settings or the App's settings.
4.1. Ownership: MOGEM retains all rights, title, and interest in and to the App, including any intellectual property rights associated with it. You shall not remove, alter, or obscure any copyright, trademark, or other proprietary notices embedded in or displayed by the App.
4.2. User Content: Any content you submit or transmit through the App, such as comments, feedback, or suggestions, shall become the property of MOGEM. You grant MOGEM a worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for any purpose.
You agree to indemnify, defend, and hold MOGEM and its affiliates, officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or relating to your use of the App, violation of this Agreement, or infringement of any intellectual property rights.
In no event shall MOGEM be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the App, including but not limited to loss of profits, data, or business opportunities.
MOGEM reserves the right to modify or update this Agreement at any time without prior notice. You are responsible for reviewing the Agreement periodically. By continuing to use the App after any modifications, you agree to be bound by the updated terms and conditions.
This Agreement shall be governed by and construed in accordance with the laws of Nigeria. Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration in accordance with the rules of the Nigerian Arbitration Centre (NAC) in Nigeria.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement constitutes the entire agreement between you and MOGEM concerning the subject matter hereof and supersedes all prior or contemporaneous understandings and agreements.
By installing, accessing, or using the Mogem Online Radio App, you acknowledge that you have read, understood, and agreed to be bound by the terms and conditions of this Agreement.
